RoboVM(tm) License Agreement

RoboVM(tm) is licensed to you by Trillian Mobile AB ("Trillian") subject to
You accepting all of the terms contained in this License Agreement. By
selecting the "I Accept" button (or the equivalent) or installing or using
RoboVM(tm) You confirm Your acceptance of this License Agreement and that this
License Agreement governs all Your use of RoboVM(tm). If You are not accepting
this License Agreement please do not select the "I Accept" button (or the
equivalent) and do not download or use RoboVM(tm).

RoboVM(tm) refers to the commercial version of the RoboVM(tm) software
provided by Trillian pursuant to this License Agreement and any updates, error
corrections, and/or program documentation provided by Trillian. If available,
program documentation may be delivered with RoboVM(tm) and/or may be accessed
from www.robovm.com.

This License Agreement applies to the commercial version of RoboVM(tm)
downloaded from www.robovm.com or from third party repositories.

RoboVM(tm) consists of compile time tools and runtime libraries. For full
technical and functional information of RoboVM(tm) please visit
www.robovm.com.

RoboVM(tm) may be used under this License Agreement by You as an individual or
by You as a representative of a company or an organisation using and/or
accessing RoboVM(tm). By accepting this License Agreement You warrant and
represent that You have the authority to enter into this License Agreement on
behalf of the organisation and/or company that You represent. If you do not
have the requisite authority, you may not accept the License Agreement or use
RoboVM(tm) on behalf of your employer or other entity.

Grant of licence and use of RoboVM(tm)
Trillian hereby grants You (as an individual or as a representative of the
company or organisation that You represent), subject to the restrictions
stated in this License Agreement, a nonexclusive, non-transferable, limited
license to internally use RoboVM(tm), and any associated program
documentation, software code or other materials made available by Trillian
solely to assist You in developing Your applications. You agree to use the
RoboVM(tm) only for purposes that are permitted by this License Agreement and
by any applicable law, regulation or generally accepted practices or
guidelines in the relevant jurisdictions (including all applicable export laws
and regulations).

It is Your responsibility to ensure that applications developed by You by use
of RoboVM(tm) are i) properly tested and ii) that You at all times comply with
the terms and conditions applicable to each application store where Your
applications developed by use of RoboVM(tm) under this License Agreement are
published. This License Agreement gives You the right to reproduce and re-
distribute the run-time libraries that constitutes part of RoboVM(tm) provided
that You only reproduce and re-distribute complete copies of such run-time
libraries, including without limitation all copyright notices and other legal
notices and terms that Trillian has included therein.

For sake of clarity RoboVM(tm) is licensed, not sold. This license only gives
You limited rights to use RoboVM(tm); all other rights are reserved. You are
entitled to use RoboVM(tm) only in accordance with this License Agreement. You
must at all times comply with any technical limitations and measures included
in RoboVM(tm). This License Agreement does not give you a right to work around
any such technical limitations and measures in RoboVM(tm). The run-time
libraries included and/or used by RoboVM(tm) are listed on
www.robovm.com/licenses.

The right to use RoboVM(tm) according to this License Agreement only include a
limited right to produce copies of RoboVM(tm). You may install the number of
copies of RoboVM(tm) allowed by Your license key provided by Trillian on your
devices to design, develop and test your applications. Each copy of RoboVM(tm)
must be complete, including all copyright and trademark notices. You may not
sell, licence, distribute, give away, or otherwise transfer RoboVM(tm) to any
third party or publish RoboVM(tm) for others to copy.

You acknowledge that Trillian owns and retains all right, title and interest
in and to RoboVM(tm) and all copyright and other intellectual property rights
relating thereto. You may not use RoboVM(tm) for any other purpose than
expressly provided for in this License Agreement. You accept that you do not
acquire any further right to RoboVM(tm), to Trillian's trademarks or other
intellectual property rights of Trillian. You are not authorized to alter,
modify, copy, edit, format, create derivative works of or otherwise use any
materials, content or technology provided under this license except as
explicitly provided in this License Agreement.

You acknowledge that any development or other work that You undertake with
RoboVM(tm) is at Your own sole risk.

RoboVM(tm) license fees
The license to use the core version (compiler and run- time libraries) of
RoboVM(tm) is free of charge.

Trillian may choose to provide RoboVM(tm) with additional functionality and/or
together with services such as support services on a subscription basis.
Subscriptions are subject to a subscription fee and You may sign up for any
subscription service from time to time available on www.robovm.com.

Upon download of the core version of RoboVM(tm) for the first time Trillian
may choose to make all or parts of the functionality that Trillian, at the
time of download, provides on a subscription basis available to You for a 30
day trial period free of charge. After the trial period has expired the
availability to such functionality will require You to sign up for a
subscription.

Re-Distributable code
RoboVM(tm) contains the re-distributable run-time
libraries listed on www.robovm.com/license that You are permitted to include
in applications developed by You on the terms stated in this License
Agreement.

If re-distributable parts of RoboVM(tm) is included in applications developed
by You under this License Agreement, You must require end users to agree to
terms of use stipulated by from time to time by Trillian (such as Apache 2.0
http://opensource.org/licenses/Apache-2.0) or on terms that protect the re-
distributable parts of RoboVM(tm) as much as this License Agreement.

Trillian's undertakings
Trillian has provided a copy of RoboVM(tm) to You and any program
documentation in order for You to be able to use RoboVM(tm) in accordance with
this License Agreement.

Trillian shall not be obliged to provide any updated versions of RoboVM(tm) or
to provide any support in relation to RoboVM(tm).

Trillian may audit Your use of RoboVM(tm).

Information Collection and Registration
The installation and auto-update processes of RoboVM(tm) transmit a limited
amount of data to Trillian about those specific processes to help Trillian
understand and optimize them, to validate license keys in order to prevent
unauthorized use and to provide other services to You.

No Technical Support
Unless support for RoboVM(tm), if any, is expressly included in a separate,
current subscription service agreement between You and Trillian, Trillian will
not provide technical support, phone support, or updates to You for RoboVM(tm)
provided under this License Agreement.

For sake of clarity, support and other services may be provided by Trillian,
against payment of fees determined by Trillian, via www.robovm.com.

Third-Party Technology
RoboVM(tm) may contain or require the use of third party technology that is
provided with RoboVM(tm). Trillian may provide certain notices to You in
program documentation, readmes or notice files in connection with such third
party technology. Third party technology will be licensed to You either under
the terms of this License Agreement or under separate terms.

Open source software
The download of RoboVM(tm) may include certain parts that are licensed under
an open source license. The license terms of such open source software may
require you to make your modifications to the open source software or any
software that You combine with the open source software freely available in
source code form. If you use open source software in conjunction with
RoboVM(tm), you must ensure that your use does not: (i) create obligations of
Trillian with respect to RoboVM(tm); or (ii) grant to any third party any
rights to the intellectual or proprietary rights in RoboVM(tm). For example,
you may not develop an application using RoboVM(tm) (or parts thereof) and an
open source program where such use results in an application that contains
code from both RoboVM(tm) and the open source program (including without
limitation libraries) if the open source program is licensed under a license
that requires any "modifications" be made freely available.

Nothing in this License Agreement shall restrict, limit or otherwise affect
any rights, obligations that You may have, or conditions that you may be
subject to under any applicable open source licenses to any open source code
contained in RoboVM(tm).

You must follow any requirements under the open source code license to publish
the open source license terms in a notice file.

Disclaimer of Warranties; Limitation of Liability
RoboVM(tm) is provided "as is" and Trillian does not give any express or
implied warranties or guarantees including without limitation, any implied
warranties of merchantability and fitness for a particular purpose or non-
infringement. You acknowledge that there might be errors or other deficiencies
in RoboVM(tm) and that Trillian shall not have any liability with regard to
such errors or deficiencies.

Trillian shall not under any circumstances be liable for loss of production,
loss of profits, special, indirect or incidental damages, loss of revenue,
loss of savings, loss of goodwill, loss of information, liability to pay
damages to third parties or any other indirect damages under this License
Agreement.

It is Your responsibility to comply with the terms and conditions applicable
to each application store where Your application developed by use of
RoboVM(tm) is published. Trillian does not warrant or guarantee that use of
the RoboVM(tm) and any re-distributable run-time libraries as part of Your
application will comply with the requirements of any application store's terms
and conditions, and Trillian shall have no liability to You for any costs,
liabilities, or damages incurred to You as a result of such noncompliance.

Beta licensed versions of RoboVM(tm)
Trillian may from time to invite You to participate in beta-testing of new
versions of RoboVM(tm) ("Beta Licensed RoboVM(tm)"). Beta Licensed RoboVM(tm)
is licensed under the License Agreement with addition of the specific Beta
Licensed RoboVM(tm) terms under this section. In case of conflict between any
provision of the License Agreement and this section, the terms in this section
shall prevail in relation to Beta Licensed RoboVM(tm).

The Beta Licensed RoboVM(tm) is made available for testing only during the
testing period stipulated by Trillian with the purpose to obtain feedback on
the performance of the Beta Licensed RoboVM(tm) and to identify defects. The
Beta Licensed RoboVM(tm) may therefore not be used in production environments.

If you use the Beta Licensed RoboVM(tm) you are presumed to provide feedback
to Trillian regarding the Beta Licensed RoboVM(tm). Such feedback may be used
by Trillian without any limitations. The Beta Licensed RoboVM(tm) is still in
testing phase and is provided on an "as is" and "as available" basis and is
believed to contain defects and errors. Trillian advice You to safeguard
important data and to not in any way rely on the correct functioning of the
Beta Licensed RoboVM(tm).

Termination
Trillian reserves the right to terminate distribution of RoboVM(tm) at any
time and at its own sole discretion.

You may terminate this License Agreement by uninstalling all downloaded copies
of RoboVM(tm) in your possession. This License Agreement shall automatically
terminate without notice if You fail to comply with any of the terms of this
License Agreement, in which case You shall promptly destroy all copies of
RoboVM(tm).

Miscellaneous
Trillian is entitled to change the terms and condition for use of RoboVM(tm)
upon giving 30 days notice by posting the new terms on www.robovm.com before
the change is in force. If You do not agree to these changes, then You must
stop using RoboVM(tm) prior to this date and promptly destroy all copies of
RoboVM(tm).

Except for distribution of run-time libraries together with your application
You are not entitled to transfer any rights according to this License
Agreement to a third party.

If any provision of this License Agreement or the application of it shall be
declared or deemed void, invalid or unenforceable in whole or in part for any
reason, the remaining provisions of this License Agreement shall continue in
full force and effect.

You confirm that this License Agreement represents the entire understanding
and constitutes the whole agreement between the You and Trillian relating to
the subject matter hereof and supersedes all prior agreements, representations
or warranties by Trillian.

Governing law and disputes
This License Agreement and any use of RoboVM(tm) shall be governed by and
construed in accordance with the laws of Sweden.

Any dispute, controversy or claim arising out of or in connection with this
License Agreement, or the breach, termination or invalidity thereof, shall be
finally settled by the district court of Gothenburg as first instance.
